Terms of Service

The short version
1. Agreement
These terms are between you and Wrad Labs Inc., a company incorporated under the federal laws of Canada (“we”, “us”), which operates Optants. By using Optants you agree to them. If you do not agree, please don’t use the service. This is version 1.0.
2. What Optants is
Optants lets people vote on head-to-head questions and see how everyone else voted. Results are aggregate counts of what our voters chose. They are not a scientific poll and are not representative of any wider population — they are the read from the people who voted here, and nothing more.
3. Voting and accounts
You can vote without an account. You may change your vote on a question; the count always reflects your current choice. An account lets you claim the votes you have already cast and take part in discussion.
We do not use passwords — anyone with access to your email can access your account, so keep your email secure. You are responsible for activity under your account. You must be at least 13 years old to use Optants, or older where the law where you live sets a higher minimum age; see the Privacy Policy.
4. Fair use of the vote
The integrity of the count is the product. You agree not to:
- vote more than once as the same person, create multiple accounts, or clear or rotate identifiers (such as cookies) in order to vote repeatedly;
- use bots, scripts or other automated means to vote, or to scrape the service;
- organise or take part in coordinated efforts to distort a result, or interfere with our anti-abuse measures;
- post content that is unlawful, hateful, harassing or defamatory, or that infringes someone else’s rights;
- attempt to break, overload or gain unauthorised access to the service.
We may remove votes we believe are manipulated, and suspend or close accounts that break these rules.
5. Content you post
You keep ownership of what you write. You give us a non-exclusive, worldwide, royalty-free licence to store, display and distribute it — including through the service providers that host and deliver Optants — as part of running and promoting the service, and you confirm you have the right to post it.
We may review, moderate or remove content, and we may decline to publish submissions. We are not obliged to monitor everything posted.
6. Our content
The service — including the Optants name, logo, design and software — belongs to us or our licensors. Aggregate results may be shared and quoted with attribution to Optants; everything else needs our permission.
7. Availability and changes
Optants is under active development. We may add, change or remove features, questions or results at any time, and the service may be unavailable from time to time. We may update these terms; if a change is material we will say so and, where it affects what you agreed to, ask you to accept the new version.
8. Ending it
You can stop using Optants at any time and delete your account from the Account page. What deletion does to your data is set out in the Privacy Policy. We may suspend or end your access if you break these terms, or if we need to for legal or security reasons.
9. No warranty, and limits on liability
Optants is provided “as is”. To the fullest extent the law allows, we make no warranties about it, including that it will be uninterrupted or error-free, or that results will be accurate or fit for any particular purpose.
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential losses, or for lost profits or data, arising from your use of the service. Nothing here limits liability that cannot be limited by law, and some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. You and we may bring proceedings in the courts of Ontario. If you use Optants as a consumer, nothing in these terms takes away your right to bring a claim in the courts of the country where you live, or the protection of any consumer law there that applies to you regardless of what these terms say.
11. General
If any part of these terms turns out to be unenforceable, the rest still applies. These terms are the entire agreement between you and us about Optants. You may not transfer your agreement to someone else; we may transfer ours as part of a reorganisation or sale of the service, on the same terms.
